When you buy a Mining Claim from us, I will cover the entire transfer process with the County and BLM at no extra charge.  Transfer to you is made by a Quitclaim Deed (in South Dakota it is a Quitclaim Mineral Deed). That takes a couple weeks.  I would also be glad to show you the claim in person anytime during the summer months with prior arrangements.  The next annual BLM claim maintenance fee is due on or before Sept 1st..  That is a yearly fee to keep the claim.  If you pay the fee you don't have to worry about assessment work per federal law.  I would be happy to answer any questions.

***Within 3 working days of receiving cleared payment, I will execute and notarize the deed to the mining claim, and mail the original for recording to the county recorder/register of deeds, and I will also mail you a copy of the deed and claim info (etc) via certified mail, return receipt, priority mail.  You will have to be present and sign for the envelope.  After the deed is recorded with the County and I receive a copy back, I will file and complete the transfer with the BLM.   Deed will be made out to buyers name/shipping address as shown on your shipping/order info.  If that needs to be corrected or changed, please let me know as soon as you purchase by message or email.  THANK YOU.  

 

Mining Claim sales are for an unpatented mining claim, so you only get the rights to the minerals and the right to extract them.  You CANNOT 

build a cabin on the claim or occupy it for any reason over 14 days except mining and mineral removal.  You do not get the rights to 

the land.  You CAN camp on your claim for as long as you want SO LONG AS YOU ARE ACTUALLY MINING OR DEVELOPING THE

CLAIM.  Other than that, dispersed  camping, is allowed on most of the Forest for a maximum of 14 days in any 60-day period.  No permits required if you are using hand tools only and no mechanized or heavy equipment.  I have been prospecting and mining in the Black Hills and around Custer since 2011 now and have never had a problem.  You do NOT have the right to keep others from hiking, camping, going across your claim, etc.  However, nobody can disturb your mineral rights or mining operations.  Nobody can pan or dig or remove any minerals from your claim, and if they do that is called mineral trespass and theft.

Purchase of a mining claim from us does NOT include any samples, reports, assays, or specimens unless explicitly stated in writing PRIOR TO purchase.

After the transfer is filed with the BLM we will mail you an information packet about your claim, and some info on how to keep and maintain your mining claim. 

 

Your next claim fee will be due to the BLM state office where your claim is located on or before SEPTEMBER 1st immediately after your purchase. It can be mailed before the due date or paid online at BLM MLRS website.   If you neglect or fail to pay that fee by the September 1st deadline, your claim will be closed by BLM automatically under the mining laws.
